(AP) ? How does a man move on with his life after losing his wife and daughters to two ruthless home invaders who tormented, then killed them?

For more than four years, a nation both disgusted and captivated by a chilling crime in prototypical suburbia has wondered that. Only one man ? Dr. William Petit, the sole survivor ? can provide the answer.

On Friday, with the second killer sentenced to death and the book closed after two long, graphic trials, Petit gave a clue as to how he copes with pain he has been forced to revisit continually in court.

"My only hope is for justice to be served and to do my best to honor the lives of my family, who should all still be here to share their gifts and love with the world," Petit said Friday right before a judge sentenced Joshua Komisarjevsky, 31, to death.

"I hope to continue to honor my family," said Petit, who survived being beaten with a baseball bat and tied up. "I push forward in the hope that good will overcome evil, and feel the need to tell the world that evil lives among us and we need to rid the world of it."

The gruesome crime evoked comparisons to Truman Capote's "In Cold Blood," about the brutal murders of a Kansas farmer and his family.

Komisarjevsky admitted in an audiotaped confession played for the jury in his trial late last year that he spotted Petit's wife, Jennifer Hawke-Petit, and their 11-year-old daughter, Michaela, at a supermarket and followed them to their house in Cheshire, a suburb of New Haven.

After going home and putting his own daughter to bed, he and Steven Hayes, now 48, returned to the Petit house in the middle of the night, while the family was sleeping, to rob it.

Dr. Petit was beaten, tied up and taken to the basement. Michaela and Hayley, 17, were tied to their beds. In the morning, Hayes took Jennifer to the bank to withdraw money, while Komisarjevsky stayed at the house.

It's believed that's when he sexually assaulted Michaela, the 11-year-old. Hayes was convicted of sexually assaulting the mother.

After Hayes arrived back at the house with the girls' mother, she was strangled. The pair doused the house and beds with gasoline, set it ablaze and left. The sisters, bound helplessly while flames and fumes rose around them, died of smoke inhalation.

Dr. Petit managed to escape the basement and hop, roll and crawl across a yard to a neighbor's house for help ? too late to save his family.

"July 23, 2007, was our personal holocaust," Petit said Friday. "A holocaust caused by two who are completely evil and actually do not comprehend what they have done."

Petit called his wife a friend, confidant and wonderful mother. He noted that Hayley would be in medical school by now and that Michaela loved to cook and sing.

"I lost my family and my home," he said. "They were three special people. Your children are your jewels."

Petit said he has difficulty sleeping and trusting. Family gatherings are subdued, he said, with no one quite sure what to do or say.

Jennifer's sister, Cynthia Hawke-Renn, said via a video played in court that everyday items like gas, rope and bedposts conjure horrific memories.

"There is no escaping the horrors of that night," she said.

Petit's father, William Petit Sr., said his son is not the same person now as he was in the days when he was a happy husband and father.

"Not only did we lose Jennifer, Hayley and Michaela, we have lost the Bill that we knew, and it is heartbreaking daily to watch him," Petit said. "He puts on a brave face and tries to hide his anguish and despair by working hard."

Petit has found what he calls occasional moments of peace, dedicating himself to a charity named for his family that raises money for education, the chronically ill and those affected by violence; and by campaigning for tougher laws, including the death penalty.

He has admitted he contemplated suicide many times. But this month he became engaged to a woman who volunteered at foundation events.

Petit has maintained his composure in court through three trials, even as the defense referred to him and his family as the "Petit posse."

Komisarjevsky's lawyers had worked to spare him the death penalty by describing sexual abuse their client endured as a child. The jury and the judge ? who had been subjected to grim evidence including pictures of charred beds, rope used to tie up the family and autopsy photos ? were unmoved.

The crime led to the defeat of a bill to outlaw the death penalty in Connecticut and sparked tougher state laws for repeat offenders and home invasions.

"This is a terrible sentence, but it is in truth a sentence you wrote for yourself with deeds of unimaginable horror and savagery on July 23, 2007," Judge Jon Blue said.

Komisarjevsky conveyed a mixture of regret and insistence in court Friday, saying that he didn't intend for anyone to die, that he didn't rape Michaela and that he didn't start the fire.

"I wonder when the killing will end," he said of his death sentence.

He described regrets and the devastating consequences of his decisions ? but blamed Hayes for the killings.

"I know my responsibilities, but what I cannot do is carry the responsibilities of the actions of another," Komisarjevsky said. "I did not want those innocent women to die."

The state's last execution in 2005 was the first since 1960, and Komisarjevsky and Hayes will likely spend years, if not decades, in prison.

William Petit and his relatives left the courtroom before Komisarjevsky spoke. The killer noted that "forgiveness is not mine to have" but said it wasn't the forgiveness of the victims' relatives he needed to find.

"I have to learn how to forgive my worst enemy ? myself," he said.

Petit's sister, Hannah Chapman, said Komisarjevsky tried to blame others when he planned and carried out the crime, escalating it by attacking her brother and molesting her niece.

"Either way, he will be damned to hell for what he did," she said, "and that is where he belongs."

FTC stops fake news sites pushing acai berry diet (AP)

WASHINGTON ? Expect to see fewer "newsy" online advertisements hawking acai (ah-sah-EE') berry diet pills.

Federal regulators announced settlements Wednesday with six online marketers who were accused of using fake news sites on the Internet to entice customers to buy acai berry weight-loss products. They promised rapid and substantial weight loss.

The Federal Trade Commission says it was all a scam.

The FTC accused the marketers of designing websites that falsely appeared as if they were part of legitimate news organizations. They flashed investigative-sounding headlines and presented a reporter's "first-hand experience" with acai berry supplements.

The proposed settlements require the marketers to make clear that their messages are advertisements and not objective journalism. They also would be barred from making deceptive claims about their products.

Arab League turns to U.N. as Gulf observers quit Syria (Reuters)

BEIRUT (Reuters) ? Gulf Arab states withdrew their observers from Syria on Tuesday after it rejected an Arab League plan for President Bashar al-Assad to surrender power, prompting the group's chief to call for U.N. help in ending Syria's bloody upheaval.

Syrian Foreign Minister Walid al-Moualem accused the League of plotting to engineer foreign intervention. Thousands of civilians and members of security forces have been killed in the 10-month-old uprising against Assad.

Despite Syria's anger, Moualem agreed to extend by a month the mission of the remaining Arab League observers who are monitoring implementation of a plan to end the bloodshed. But he scornfully rejected the League's latest proposal.

"Definitely the solution in Syria is not the solution suggested by the Arab League, which we have rejected. They have abandoned their role as the Arab League and we no longer want Arab solutions to the crisis," Moualem said.

"Heading to the Security Council will be the third stage in their plan, and the only thing left is the last step of internationalization," he told a news conference in Damascus.

"They can head to New York or to the moon. So long as we are not paying for their tickets it is none of our concern."

The revolt in Syria was inspired by others that have toppled three Arab leaders and the bloodshed has battered Assad's standing in the world, with Iran among his few remaining allies.

On Tuesday, the death toll rose to 26 by the evening, the Syrian Observatory for Human Rights said. Fifteen were killed in clashes between state forces and armed rebels in the flashpoint province of Homs.

Arab League officials said 55 Gulf Arab observers were being withdrawn while the other 110 members of the team would continue work in Syria.

State news agency SANA said Moualem told Arab League chief Nabil Elaraby that Damascus had agreed to extend the monitoring mission until February 23.

The Gulf Cooperation Council states said in a statement they were "certain the bloodshed and killing of innocents would continue, and that the Syrian regime would not abide by the Arab League's resolutions."

Elaraby and Qatari Prime Minister Hamad bin Jassim al-Thani, who heads the League's committee on Syria, sent a joint letter to U.N. Secretary General Ban Ki-moon giving details of the organization's latest plan for a political solution in Syria.

The letter asks for a "joint meeting between them in the U.N. headquarters to inform the Security Council about developments and obtain the support of the Council for this plan," a League statement said.

The Saudi ambassador to Britain, Prince Mohammad Bin Nawaf, said the idea of resorting to the Security Council was to rally the world behind the Arab League peace initiative for Syria.

"We pulled out (the monitors) because we didn't see any positive response from the Syrian government. But it is a process. Take it to the U.N. Security Council to get the support on that initiative," he told journalists in London.

"We hope it doesn't reach an escalation of a military intervention. The last thing we want is an unstable region. We hope the Syrian regime will comply with the Arab initiative. I think this is the logical way out, a peaceful solution, a peaceful transition. I think this is the only hope they have."

GULF ARAB WALKOUT

Moualem poured contempt on the League's call for Assad to hand power to a unity government to defuse the violence.

He said that while "half the universe is against us," Syria's long-time ally and arms supplier Russia, which wields a veto on the Security Council, would never permit foreign intervention. "That is a red line for them."

Still, the Arab League's call for a change of Syrian government, coupled with the diminution of the monitoring mission, will raise pressure on the Security Council to overcome its divisions and act to stop Syria's bloodshed.

More than 5,000 people have been killed since the revolt erupted in March, according to the United Nations. Damascus says "terrorists" have killed more than 2,000 soldiers and police.

What began as civilian street protests has escalated into an armed insurgency in some regions as Assad has sought to crush unrest with troops and tanks.

The presence of the monitors has not halted the violence, as envisaged under a peace plan Damascus approved. The Arab observers deployed late last month to assess Syria's compliance with an earlier Arab League plan.

"There has been some progress, but there has not been immediate or complete implementation as the Arab initiative requires," Elaraby said on Tuesday, adding that he would name a special envoy to Syria this week.

A Syrian opposition group condemned the mission's leader, Sudanese General Mohammed al-Dabi, for a report in which he highlighted violence by Assad's adversaries as well as by the president's security forces.

The Syria-based Local Coordination Committees criticized Dabi for equating "the butcher and the victim," saying he had "blurred the monumental hardship that millions of Syrians experience every day while they rise to reach freedom, dignity, democracy and a wise system of governance."

French Foreign Minister Alain Juppe said the Security Council's silence on Syria was scandalous, but that the Arab League call for Assad's removal was "a glimmer of light."

The Arab League's request for the Council to endorse its plan will force could be a "game changer," Germany's U.N. envoy Petter Witting said, and may finally force the world body to take a stand on Syria's crisis.

A pretrial agreement means Marine Staff Sgt. Frank Wuterich, the last defendant in the Haditha trial, will not serve any time in prison for his role in the killing of 24 Iraqis in 2005.

That?s the question defense analysts are asking on the heels of a Marine Corps judge?s recommendation Tuesday that the sergeant in charge of a team of US troops responsible for killing 24 Iraqis, including seven children, receive 90 days confinement and reduction to the rank of private.

As a result of a pretrial agreement, however, Staff Sgt. Frank Wuterich will not serve any time in prison.

Staff Sgt. Wuterich was the final defendant to be tried in what became the infamous Haditha case. Seven other US troops were charged along with Staff Sgt. Wuterich for their actions at Haditha in 2005 and for allegedly obstructing justice afterward.

Six ultimately had their cases dropped, and one was acquitted.

Following closely on the heels of revelations about Abu Ghraib prisoner abuse, Haditha became synonymous with accusations that the US military was recklessly disregarding the safety of civilians and those in its custody.

After a roadside bomb killed one Marine and two others on the morning of Nov. 19, 2005, in the Anbar Province town of Haditha, Wuterich and his squad went on a rampage, allegedly in pursuit of a gunman who fired on them from a house after the explosion. Wuterich was accused of manslaughter, assault, and dereliction of duty for his role.

During the plea hearing Monday, Wuterich expressed regret for his decision to ?shoot first, ask questions later.? Throughout the trial, the defense team emphasized the fog of war and Wuterich?s duty to protect his fellow Marines from harm.

Wuterich?s plea bargain, struck by military lawyers, stipulated that he receive no more than three months in prison. He remains on active duty.

The sentence handed down by the Marine Corps judge, Lt. Col. David Jones, is only a recommendation, however. The final decision about whether Wuterich will serve jail time or not is ultimately up to the commander of the 1st Marine Expeditionary Force, Lt. Gen. Thomas Waldhauser. According to a Marine Corps statement, that decision will come ?once he has fully reviewed the case.?

But the very terms of the plea bargain in a case in which two dozen civilians were killed suggests that ultimately, history will likely conclude that in the case of Haditha, the military justice system didn?t work, argues David Glazier, a professor of law at Loyola Law School Los Angeles and a former career US Navy officer.

?The justification for having a separate system of military justice is primarily to be able to maintain good order and discipline,? he says. ?That requires prompt investigation and punishment of wrongdoing.?

It took six years to bring Haditha to trial.

?The first problem was failure in the chain of command to recognize that there was a potential crime,? Mr. Glazier says. The commander in charge of Wuterich?s unit ?when he first heard the problem, refused to believe it. He said, ?Not my Marines.? ?

In other words, loyalty to the troops trumped loyalty to the constitution, and resulted in failure ?to conduct a meaningful investigation immediately,? Glazier says.

Abortion Safer for Women Than Childbirth, Study Claims (HealthDay)

MONDAY, Jan. 23 (HealthDay News) -- Since the U.S. Supreme Court legalized abortion in 1973, opponents have questioned the safety of medical procedures used to terminate pregnancy. Now, a new study contends that having a legal abortion is safer than carrying a baby to term.

The risk of death associated with a full-term pregnancy and delivery is 8.8 deaths per 100,000, while the risk of death linked to legal abortion is 0.6 deaths per 100,000 women, according to the study. That means a woman carrying a baby to term is 14 times more likely to die than a woman who chooses to have a legal abortion, the study finds.

"Regardless of one's sentiments about abortion, legal abortion is very safe, and dramatically safer than continuing the pregnancy," said the study's lead author, Dr. David Grimes, a clinical professor in the department of obstetrics and gynecology at the University of North Carolina School of Medicine at Chapel Hill.

Sunday was the 39th anniversary of Roe vs. Wade, the landmark case that struck down state laws prohibiting abortion.

Grimes and his colleagues had several reasons for undertaking the study, published in the February issue of Obstetrics & Gynecology. One is that medical abortion, in which a woman can take a pill early in pregnancy, instead of surgical abortion, "has changed the landscape of abortion, and the mortality information needed to be updated."

Another reason is that in many states, women are given information before getting an abortion. "There's been a proliferation of these women's-right-to-know pamphlets, and some of them are misleading, if not downright incorrect or patently wrong," Grimes said.

A pamphlet given out in Texas lists more complications for abortion than it does for pregnancy, he explained. "Someone without a medical background might infer that abortion is more dangerous than continuing a pregnancy," he said.

To estimate the risk of death, the authors combined information from several national datasets gathered between 1998 and 2005. One, from the U.S. Centers for Disease Control and Prevention, listed the number of pregnancy-related deaths in women delivering live babies. Another CDC dataset gave the number of legal abortions performed in the United States. Information on deaths from legal abortion came from an estimate provided by the Guttmacher Institute, which conducted an annual survey of U.S. hospitals, clinics and physicians' offices that provide abortions. The Guttmacher Institute also provided information from abortion patient surveys, and the researchers searched published studies for additional estimates of mortality.

From known live births, they found there were 2,856 deaths in women between 1998 and 2005. That translates to a risk of death of 8.8 per 100,000 pregnancies, according to the study.

For legal abortion, 64 deaths were reported in the same time frame. That translates to a risk of 0.6 deaths per 100,000 pregnancies, the study authors said.

In addition, the authors found that complications -- such as postpartum hemorrhage, infections and high blood pressure disorders -- were more common in women choosing to continue their pregnancies. This is, in part, because a woman with a full-term pregnancy has that much more time for pregnancy-related problems to develop, the authors said.

Dr. Donna Harrison, director of research and public policy at the American Association of Pro-Life Obstetricians and Gynecologists, disagreed with the authors' conclusions. This study's findings are "speculation," she said.

"Abortion mortality is not systematically collected. What Dr. Grimes' paper most clearly illustrates is the immediate need for reporting requirements for abortion deaths in all 50 states," Harrison said.

"Abortion carries significant risks to the mother in addition to death, and women need to have good and accurate information," Harrison said. "Since we don't have an objective academic format yet, the information provided should probably be left up to the state medical boards and agreed to by the state legislature."

Dr. Mitchell Creinin, professor and chair of obstetrics and gynecology at the University of California, Davis, said that pregnant women considering their options "are often scared by the rhetoric."

"If a state is going to feel a responsibility to be involved in this private matter, we need to ensure that the material is factual," said Creinin, who wrote an accompanying editorial in the same issue of the journal. "If it comes from the state or the government, people assume it's true," he added.

On its website, the Guttmacher Institute describes its mission as advancing "sexual and reproductive health and rights through an interrelated program of research, policy analysis and public education designed to generate new ideas, encourage enlightened public debate and promote sound policy and program development."

Jake Burton Kicking Cancer's Ass at Boardistan

Jake BurtonWe?re super stoked to report that according to a memo sent out to Burton employees this week Jake Burton?s ?cancer is toast.? Jake says:

It appears that my cancer is toast. It?s scans and observation from here forward. There is still the possibility of surgery or some radiation down the road, but it will be clean-up in nature and I?m not too stressed about it. As my oncologist Steven Ades said, ?Jake, you get your diploma?. . . As I transition from being a patient to being a survivor, I move on with enormous respect for both cancer (?The Emperor of Diseases?) and chemotherapy (how can something so beneficial be so simultaneously harmful).

I have also grown to appreciate those around me more than ever. From my soul mate Donna (I can?t even start) to my three boys: George came home from a semester off in Chile to help out for 3 months (he left as one of my best friends) and Timi and Taylor who went out of their way on a valuable vacation powder day to spend my last day of chemo with me passing out cupcakes to the whole clinic. Our extended families and friends also went out of their way to do anything possible to make life easier for us.

The Burton family and the entire board sports industry could not have been cooler about the whole ordeal. Burton has so much momentum I wonder if they really need me. The Senior Management Team stepped up to the plate big time. Assistants Harriet, Roberta and Katie ran my life without me. I owe so many people so much.

Looking ahead I am pretty much broken. While I am on the mend, I have a lot of healing to do. I take great pride and happiness in my ability to ride 100 days a year and surf a bunch too. Strongest solar storm since 2005 hitting Earth (AP)

WASHINGTON ? The sun is bombarding Earth with radiation from the biggest solar storm in more than six years with more to come from the fast-moving eruption.

The solar flare occurred at about 11 p.m. EST Sunday and will hit Earth with three different effects at three different times. The biggest issue is radiation, according to the National Oceanic and Atmospheric Administration's Space Weather Prediction Center in Colorado.

The radiation is mostly a concern for satellite disruptions and astronauts in space. It can cause communication problems for polar-traveling airplanes, said space weather center physicist Doug Biesecker.

Radiation from Sunday's flare arrived at Earth an hour later and will likely continue through Wednesday. Levels are considered strong but other storms have been more severe. There are two higher levels of radiation on NOAA's storm scale ? severe and extreme ? Biesecker said. Still, this storm is the strongest for radiation since May 2005.

The radiation ? in the form of protons ? came flying out of the sun at 93 million miles per hour.

"The whole volume of space between here and Jupiter is just filled with protons and you just don't get rid of them like that," Biesecker said. That's why the effects will stick around for a couple days.

NASA's flight surgeons and solar experts examined the solar flare's expected effects and decided that the six astronauts on the International Space Station do not have to do anything to protect themselves from the radiation, spokesman Rob Navias said.

A solar eruption is followed by a one-two-three punch, said Antti Pulkkinen, a physicist at NASA's Goddard Space Flight Center in Maryland and Catholic University.

First comes electromagnetic radiation, followed by radiation in the form of protons.

Then, finally the coronal mass ejection ? that's the plasma from the sun itself ? hits. Usually that travels at about 1 or 2 million miles per hour, but this storm is particularly speedy and is shooting out at 4 million miles per hour, Biesecker said.

It's the plasma that causes much of the noticeable problems on Earth, such as electrical grid outages. In 1989, a solar storm caused a massive blackout in Quebec. It can also pull the northern lights further south.

But this coronal mass ejection seems likely to be only moderate, with a chance for becoming strong, Biesecker said. The worst of the storm is likely to go north of Earth.

And unlike last October, when a freak solar storm caused auroras to be seen as far south as Alabama, the northern lights aren't likely to dip too far south this time, Biesecker said. Parts of New England, upstate New York, northern Michigan, Montana and the Pacific Northwest could see an aurora but not until Tuesday evening, he said.

For the past several years the sun had been quiet, almost too quiet. Part of that was the normal calm part of the sun's 11-year cycle of activity. Last year, scientists started to speculate that the sun was going into an unusually quiet cycle that seems to happen maybe once a century or so.

Now that super-quiet cycle doesn't seem as likely, Biesecker said.

Scientists watching the sun with a new NASA satellite launched in 2010 ? during the sun's quiet period ? are excited.

"We haven't had anything like this for a number of years," Pulkkinen said. "It's kind of special."

Before getting started, make sure you are running iOS 5.0.1, as this jailbreak will only work on iOS 5.0.1 and not 5.0.0. If you're still running 5.0.0, update to 5.0.1. Also, be sure your iDevice does not run on an A5 chip. (This means iPad 2s and iPhone 4S'.) Any earlier device that can run iOS 5.0.1 should work just fine. (This means the iPhone 3GS, iPhone 4 GSM, iPhone 4 CDMA, iPad 1, iPod touch 3G, and iPod touch 4G.)

Download redsn03 0.9.10b1 for Mac OS X or Windows.

Connect your iDevice to your computer, open up the redsn0w application, and turn off your iDevice.

On the redsn0w application window you'll see a Jailbreak button. Click it. You'll be told you'll need to put your iDevice into DFU mode and to click the Next button when ready. When you are ready, go ahead and click it.

Hold down the power button at the top of your iDevice for three (3) seconds. Next, continue holding down the power button but also hold down the home button for a total of 10 seconds. Finally, let go of the power button but continue holding down the home button for another 15 seconds, or until redsn0w changes screens and tells you it's exploiting your device for the jailbreak.

Once redsn0w has finished doing its business, it'll ask you what you want to do for this jailbreak. By default, only Cydia will be checked. Most of the other options are irrelevant, but you might want to check Enable multitouch gestures if you want additional multitouch gestures on your iPhone or iPod touch.

Wait a few minutes for the jailbreak to finish and for your iDevice to reboot. Once it has booted, you'll see the Cydia icon on your home screen (although it may not be on the first page, so look around). Open it up and you'll have access to a bunch of jailbreak hacks.

The greenpois0n absinthe method is pretty simple. You just plug in your iPhone or iPad (there's no need to enter DFU mode or even turn it off), open the absinthe jailbreak app on your Mac or Windows PC, and click the jailbreak button.

Wait for a while. Your device will go into a fake restore session and reboot. When it reboots, DO NOT TOUCH IT. The jailbreak process isn't over yet. You will be notified on-screen when absinthe has finished its work. It will tell you to find the quote-unquote jailbreak app on one of your home screen pages. The app is not labeled jailbreak, but rather absinthe. Tap that app and it should cause your device to reboot with the jailbreak complete.

If that doesn't happen, however, just open up the Settings app on your device and flip the VPN toggle switch to on (it'll be towards the top of your main settings options). You'll receive an error, which you need to dismiss, and then after a few seconds your device will reboot.

Rescued kidnapping victim Elizabeth Smart engaged (AP)

SALT LAKE CITY ? A Utah woman kidnapped at knifepoint at age 14 and held captive for nine months is getting married.

A spokesman for 24-year-old Elizabeth Smart says she got engaged last weekend and will likely marry in the summer.

No details about the groom-to-be were disclosed. The spokesman says Smart plans to keep her personal life private.

Smart's father, Ed Smart, tells The Associated Press his future son-in-law is a "fine young man." Ed Smart says he's pleased for his daughter and hopes she has a happy life.

Onetime itinerant street preacher Brian David Mitchell was convicted in 2010 of Smart's 2002 kidnapping and sexual assault. He's serving a life prison sentence.

Weslaco finance director resigns | weslaco, director, finance ...

WESLACO?The search is on for a new finance director after its money manager, Bret Mann, submitted his resignation Wednesday.

Olivares announced the departure to staff Thursday morning. Mann will officially remain the finance director until Feb. 1, but because he had leave available, his last day was Friday.

Mann is the third finance director Weslaco has had in the past two years. The city has faced a tumultuous financial challenge during that time and pursued cost saving techniques that included widespread staff cuts.

?That was one of the reasons I took the position, kind of as a challenge, to see if I could get the city back on path and I think we are,? Mann said.

At a presentation to city commissioners Jan. 3, Mann touted the city?s approximately $825,000 general fund balance when the fiscal year ended Sept. 30?up from negative numbers the year before?and said the city would be about $3.3 million in the hole without changes they had made in city practices.

City Manager Leo Olivares called Mann ?a key component of our Weslaco transformation? and said he was sorry to see him go. He said he hopes to find someone else with comparable experience.

?He?s more of a CFO and he brought that mentality to the position,? Olivares said. ?He?s really upped the game as far as financial management.?

Weslaco began advertising Friday for a new director. Because the position is that of an employee rather than an officer of the city, its selection is up to Olivares. He said he would be looking for applicants with, at minimum, an accounting degree and at least three years of experience in public accounting.

Mann said his departure did not stem from any problems with the city but from a decision to pursue an opportunity in the private sector.

?It?s one of those things where I don?t want to be kicking myself later for not doing it, not trying it,? he said.

Sonnen vs. Bisping is for title shot, but Chael says Silva will never fight him

Dana White released his first video blog for the card on FX today. One interesting scene includes the UFC president dealing with the withdrawal of Mark Munoz from the UFC on Fox 2 card. White is getting ready to release news of the new Chael Sonnen-Michael Bising fight and says the winner will get a title shot against the currently sidelined UFC middleweight champ Anderson Silva.

White must know something Sonnen doesn't because the outspoken contender sounds pretty sure he'll never face Silva.

"I'm not going to fight Anderson either way. They can say whatever they want. Anderson is never going to do that fight," Sonnen told "The MMA Insiders" show last week on Las Vegas' ESPN1100/98.9 FM. "I hope he's healthy and has a good life, but I'm not buying into this mythical world that Anderson is going to some day sign a contract to fight me."

During today's UFC on Fox 2 conference call, Sonnen reiterated his theory and said Silva turned down the fight to their boss' face.

"He even said no to (UFC executive) Lorenzo Fertitta's face. Face-to-face, not over the phone ? Lorenzo brought him out, sat him down, and said, 'This is the fight we want.' And Anderson said no," said Sonnen.

Sonnen knows management isn't pleased and questions the severity of Silva's back and shoulder injuries.

"They're not happy about it. The message to Anderson was this ' Chael is the opponent for you. You can fight him or you can't fight nobody. He elected to fight nobody,'" said Sonnen. "Dan Henderson said it perfectly, if the right opponent comes up, all of Anderson's injuries will go away."

Silva's next opponent will be known next Saturday night. A date and location is completely up in the air until Silva announces when he can officially return.

Redbox, on-demand are how we like our movies

Redbox's kiosks are now the leading source of physical DVD rentals in the U.S., and video-on-demand accounts for one out of three paid movie rentals.

"Brick-and-mortar retail stores continue to cede movie-rental market share, as kiosks and digital-streaming rentals become more accepted by consumers," said The NPD Group Thursday.

"There's no doubt that Redbox has been the largest beneficiary of the collapsing brick-and-mortar store rental business, especially with ongoing Blockbuster store closings and the fact that there are also fewer independent stores than the prior year," said Russ Crupnick, senior vice president, industry analysis for The NPD Group, in a release.

Netflix remains the "dominant provider of paid digital movie rentals, posting a 55 percent share in the fourth quarter of 2011, though Netflix's share is down somewhat from the company's peak of 59 percent" in the second and third quarters of last year,?according to the?The NPD Group.

The research firm said U.S. consumer rental of movies in DVD and Blu-ray disc formats fell by 11 percent in 2011 from 2010. The leader for actual disc rentals was Redbox, which saw its unit volume up by 29 percent in 2011 over the year before.

Some consumers may have been driven to Redbox or video on demand after giving up on Netflix, whose price hikes last year angered consumers.

The company's "share erosion may have resulted from their recent well-publicized challenges with pricing, and from their now defunct Quikster (DVDs-only) experiment," Crupnick said. "However, they are in the process of shifting customers to their Watch Instantly option, so not all of the physical movie rental share drop is a net loss."

The movie rental market is "clearly undergoing a sea change, as consumers become better equipped to access on-demand and streamed movies and are more comfortable with available delivery options," he said. But, he added, "Even so, renting physical discs from now-ubiquitous kiosks in grocery stores and other venues has taken the lead as the most popular movie-rental method in the U.S."

"Now-ubiquitous" is right, for Redbox. You can't, it seems, go a block or past a grocery store or drugstore without finding the red kiosks, almost as prevalent as Starbucks. One down side is that when you're at the kiosk, if something goes wrong during the purchase process, you can be stuck (despite an 800 number to call that often results in a long, long wait) ? something you don't want to do standing near a parking lot.

(AP) ? Photography icon Eastman Kodak has filed for Chapter 11 bankruptcy protection, as it seeks to boost its cash position and stay in business.

The move comes as the ailing company has failed to find a buyer for its trove of 1,100 digital imaging patents. Kodak said in November that it could run out of cash in a year if it didn't sell the patents, for which it hoped to fetch billions.

Eastman Kodak Co. said early Thursday that it has secured $950 million (?740 million) in financing from Citigroup Inc., and expects to be able to operate its business during bankruptcy reorganization and pay employees. The Rochester, New York-based company, which was pummeled by foreign competition and then severely shaken by the digital revolution, has invested huge sums in new lines of inkjet printers that are finally on the verge of turning a profit.

CEO Antonio Perez said in a statement that the bankruptcy filing is "a necessary step and the right thing to do for the future of Kodak."

The company and its board are being advised by Lazard, FTI Consulting Inc. and Sullivan & Cromwell LLP. Dominic DiNapoli, vice chairman of FTI Consulting, will serve as chief restructuring officer. Kodak expects to complete its U.S.-based restructuring during 2013.

On its website, Kodak assured customers that the nearly $1 billion in debtor-in-possession financing would be sufficient to pay vendors, suppliers and other business partners in full for goods and services going forward. The bankruptcy filing in the Southern District of New York does not involve Kodak's international operations.

The Chapter 11 filing had been rumored for weeks. Multiple directors have resigned from Kodak's board and the company last week announced that it realigned and simplified its business structure in an effort to cut costs, create shareholder value and accelerate its long-drawn-out digital transformation. Since the start of the year, Kodak said it now has two business units ? commercial and consumer ? instead of three.

Previously, Kodak's business segments were divided into its traditional film and photo paper products, consumer digital imaging and graphic communications, which included printing equipment.

Home photo printers, commercial inkjet presses, workflow software and packaging are viewed as Kodak's new core. Kodak has said it hopes the printer, software and packaging businesses will more than double in size by 2013 and account by then for 25 percent of its revenue, or nearly $2 billion.

Kodak did not announce job cuts as part of the bankruptcy protection filing. The company's payroll has plunged below 19,000 from 70,000 a decade ago.

Car bomb kills 8 in northern Iraq (AP)

BAGHDAD ? A car bomb killed at least eight people outside the northern city of Mosul on Monday, Iraq officials said, in the latest in a series of attacks to target the country's Shiites since the U.S. withdrawal last month.

Violence has surged across Iraq since the last American troops left the country, with a string of bombings that has left at least 150 people dead since the beginning of the year. Most of the attacks appear to be aimed at Iraq's Shiite majority, suggesting Sunni insurgents are seeking to undermine the Shiite-dominated government.

Monday's blast struck a Shiite district outside of Mosul, a predominantly Sunni city some 225 miles (360 kilometers) northwest of Baghdad, a police official said.

An official at Mosul's Al-Jomhouri hospital confirmed the death toll, and said at least six people were wounded in the attack.

Both officials spoke on condition of anonymity because they were not authorized to brief the media.

A member of the city's local council, Qusai Abbas, said the car bomb blew up near a group of houses where members of the Shebek minority have settled since being driven out of Mosul by Sunni militants during fierce sectarian fighting a few years ago.

The Shebeks are ethnic Turkomen and Shiite Muslims who mostly live in villages east of Mosul, the provincial capital of the ethnically mixed Ninevah province that is predominantly Sunni Muslim.

Mosul has been a hub for al-Qaida in Iraq in past years. Other Sunni insurgent groups have battled Kurdish militias for control over the city, Iraq's third largest, killing thousands of civilians in suicide bombings and shootings.

Hundreds of Christians, Yazeedis and members of other minority groups have been driven out Mosul in recent years as militants used violence and intimidation to tip the ethnic and religious balance into their group's favor.

Iraq is also facing a political crisis after the Shiite-dominated government charged Sunni Vice President Tareq al-Hashemi with running death squads, issuing an arrest warrant against him just as the last U.S. soldiers crossed into neighboring Kuwait.

The sectarian crisis in the government and the spike in attacks ? such as a bombing Saturday that killed more than 50 Shiite pilgrims and an assault Sunday on government buildings in western Anbar province that killed seven ? has raised concerns Iraq could return to the sort of sectarian bloodshed that killed tens of thousands of civilians after the 2003 U.S.-led invasion and brought the country to the brink of civil war in 2006 and 2007.

US forward Buddle has try out at EPL club Everton

LIVERPOOL, England - The agent of Edson Buddle says the American forward is having a trial at English Premier League club Everton, which already has compatriots Tim Howard, Landon Donovan and Marcus Hahnemann on its roster.

The 30-year-old Buddle, who appeared at the 2010 World Cup, is currently at German second-tier club Ingolstadt.

Buddle's representative Richard Motzkin said on Twitter that the former Los Angeles Galaxy player is at Everton this week during the German season's winter break.

Another of Motzkin's clients, Donovan, has been loaned to Everton from the Los Angeles Galaxy during Major League Soccer's offseason. Howard has been Everton's goalkeeper since 2007, and Hahnemann joined as a backup in September.

Huntsman departure a marginal help to Romney in SC (AP)

COLUMBIA, S.C. ? Republican Jon Huntsman's endorsement of Mitt Romney further cements Romney as the favorite in Saturday's pivotal South Carolina primary, adding another name to the list of party figures calling him best able to beat Democratic President Bararck Obama.

However, it leaves Romney's more conservative rivals still fighting with one another to emerge as his strongest challenger. And it prompted at least one backer of Texas Gov. Rick Perry to urge him to quit the race.

Besides offering Romney his support, Huntsman also appealed for civility in a race that has become defined by attack advertisements paid for by anonymous groups.

"At its core, the Republican Party is a party of ideas, but the current toxic form of our political discourse does not help our cause," he said, as televisions and telephones across the state hummed with attack messages.

Huntsman's endorsement offers little in the way of a campaign organization or bankable support to Romney.

But it does add to the sense of inevitability the former Massachusetts governor has worked to portray in a state that has voted for the eventual GOP since 1980 and where he is campaigning with backing from the state's new Gov. Nikki Haley and Arizona Sen. John McCain, winner of the 2008 primary here.

Romney stands a good chance of winning the votes Huntsman would have received. Both tout business backgrounds and are social moderates in a state where social conservatives are an influential bloc. Polls show Romney was most often the second choice of Huntsman backers.

"Certainly, it will help Gov. Romney here, it's just not clear how much," said former state Attorney General Henry McMaster. An early Huntsman supporter, McMaster had not committed to another candidate after Huntsman's announcement.

But Huntsman's leaves unanswered the overriding question of the Republican campaign: whether voters looking for a candidate more conservative than Romney will unite behind Rick Santorum, Newt Gingrich or Perry and send a strong challenger to compete against Romney in the Florida primary or beyond.

Santorum, a former Pennsylvania senator, dismissed the endorsement during a campaign stop at a Columbia restaurant. "Moderates are backing moderates," he said. "No surprise there."

Gingrich, the former House speaker locked in a bitter battle with Romney, said at an appearance in Myrtle Beach: "Why would you want to nominate the guy who lost to the guy who lost to Obama?"

Gingrich also quickly noted late Sunday, as news of Huntsman's decision broke, that a Greenville businesswoman who had supported the former Utah governor was coming over to Gingrich.

Although Huntsman's departure hardly assures Romney of victory in Saturday's primary, it underscored the tension within the party's conservative wing with just five days left for one of them to emerge.

Santorum was the consensus, if not unanimous, choice of a group of national Christian political activists who met over the weekend in a last-ditch effort to rally conservatives.

"I think it's important that we eventually consolidate this race," Santorum said, stopping short of saying pressure was building on Perry to drop out. "That's up to the candidates themselves to decide."

Polls in South Carolina showed Romney in the lead, followed by Gingrich with Santorum and Texas Rep. Ron Paul fighting for third. Perry trailed in single digits.

A few of Perry's backers have begun calling on him to leave the race.

"There are a lot of conservatives who were happy to see him get in and now who would be happy to see him get out," state Rep. Larry Grooms, an early Perry supporter, told The Associated Press. "When conservatives have split in the past, we end up nominating a moderate, and that's not good for our party."

Conservative author Eric Metaxas indirectly suggested Perry should quit the race while speaking at a packed prayer breakfast in Myrtle Beach on Sunday. The night before he had tweeted: "Dear Gov. Perry: Do the right thing for your country; endorse Rick Santorum before the SC Primary next Saturday...you'll wish you had."

Some South Carolina Republicans still rue McCain's narrow 2008 win over the more socially conservative Mike Huckabee, allowed largely by former Tennessee Sen. Fred Thompson's decision to stay in the race.

Katon Dawson, Perry's South Carolina chairman, resisted the idea that there was a drumbeat for Perry to quit. "I find it sort of offensive that some Republicans would tell us they want to hand pick the candidate before the election," Dawson said.

Ralph Reed, founder of the national Faith and Freedom Coalition, also said he knew of no effort by the conservative leaders who met Saturday in Texas to urge Perry to quit.

"We have never asked any candidate to drop out of the race publicly or privately. And we will not do so," Reed said.

Some evangelical pastors and conservative leaders in Iowa had asked Minnesota Rep. Michele Bachmann to consider ending her campaign to allow a conservative to emerge. She did not, and Romney edged Santorum in Iowa by a razor-thin eight votes.

With Perry showing no signs of departing, Santorum faces the added burden of a barrage of attack ads by an independent super PAC that supports Romney's campaign.

The group, Restore Our Future, was running almost $900,000 worth of advertising this week, more than any of the candidates' campaigns and all of it against Santorum.

Santorum complained Monday about the ads, which accuse him of having supported earmark spending in Congress and supporting voting rights for felons.

Santorum has defended his support for earmark spending. He said Monday he supports allowing felons who have completed their sentences to apply to have their voting rights restored, a policy that is law in 48 states.

Restore Our Future spent roughly $3 million on similar anti-Gingrich ads in the final month of the Iowa campaign and was seen as contributing to his fourth-place finish in the caucuses.

A similar group that supports Gingrich was running roughly $850,000 in ads against Romney.

Joseph Calleja's golden voice graces 'Faust' (AP)

NEW YORK ? Friday the 13th turned out to be a lucky night at the opera for fans of Joseph Calleja.

After missing part or all of two previous performances because of illness, the Maltese tenor was back in golden voice to take over the title role in Gounod's "Faust" at the Metropolitan Opera.

From his opening phrases as the aged scientist who sells his soul to the devil to regain his youth, Calleja displayed the quality that makes his voice instantly recognizable ? a warm, sun-kissed sound enhanced by a rapid vibrato that focuses his tone rather than spreading it.

There's an ease and a generosity in his vocalism as well. When he took a diminuendo, gradually lowering the volume on the high C that caps the aria "Salut, demeure chaste et pure," his face glowed with a sense of pride and pleasure in sharing the rare accomplishment with his rapt audience.

Stepping into the Des McAnuff production late in the run, Calleja had a rumpled, slightly bemused look and was a bit of a cipher dramatically. But what does that really matter, when he is able to communicate so thrillingly with his voice?

Calleja was part of an almost entirely new cast for "Faust," the only holdover from the opening being soprano Marina Poplavskaya, who repeated her vocally flawed but dramatically compelling performance as Marguerite.

The other most notable newcomer was bass Ferruccio Furlanetto, who sounded in astonishingly robust voice as Mephistopheles for someone who began singing major roles at the Met more than 30 years ago.

Furlanetto, sporting a Van Dyke beard that made him resemble a silent movie villain, brought a dark, menacing sound to the role ? very different from the suave and silky tones of his predecessor, Rene Pape. His mocking serenade to Marguerite had a nasty bite to it, and his powerful outbursts in the church scene sounded, well, downright diabolical.

The bright-voiced mezzo-soprano Kate Lindsey did a fine job with the trousers role of Siebel; as Marguerite's implacable brother, Valentin, baritone George Petean failed to make much impact in his aria or his death scene.

The orchestra played well for conductor Alain Altinoglu, but his reading of the score was oddly fitful, buoyant at times, but also dragging in spots.

There are two more performances with the same cast this week.

Lumia 900 set for March release: report

The Lumia 900, Nokia's new Windows Phone, could hit shelves in the US as soon as March, according to one reporter.?

Earlier this month, Nokia took the wraps off the Lumia 900, a smartphone equipped with a 4.3-inch high-resolution display, 512MB of RAM, an 8-megapixel camera, and the Windows Phone?Mango operating system. The new Windows Phone OS has been a hit among reviewers, but the phones that it runs on have so far been rather lukewarm. Nokia hopes to change that with this Lumia line, which has performed consistently well in Europe.?

And according to tech reporter Paul Thurrott, the Lumia 900 could be arriving as soon as March ? earlier than many tech insiders had suspected. Thurrott, who runs the SuperSite for Windows blog, made the comments during a video interview?from the floor of CES, the annual electronics show in Las Vegas.

The timing would be propitious for Nokia, which could get out in front of the crushing press blitz sure to surround the next iPhone, while sustaining the already?high level?of Lumia buzz.?The Lumia 900, after all, has been called "one of the hottest phones" at CES ? a svelte, a high-powered piece of eye-candy.?

"The Lumia 900 beautifully showcases the Windows Phone OS," Ginny Mies of PC World wrote in a hands-on test of the Lumia this week. "The body is made from a single injectable polyurethane matte plastic build,?as is the Lumia 800, which gives it a sturdy feel. The material is soft to touch, but resistant to scratches (although not necessarily fingerprints). And it doesn't feel like it will completely shatter if you drop it."

Not that everyone is totally blown away. Writing at Ars Technica, Casey Johnston lamented the undersized battery life on the Lumia 900.?

"In our eyes, the biggest red flag, relatively speaking, on the Lumia 900's spec sheet is the battery life: Nokia estimates the phone's 1830mAh battery (a generous size for a smartphone) will get up to 7 hours of 3G talk time and 6.5 hours of video," Johnston notes. "While the phone is undoubtedly faster than other Windows Phone devices we've tried, this suggests that it's operating at too high a level for a decent battery life."?

The mission of the Chapter is to promote the design, construction, and operation of sustainable buildings and communities in Massachusetts through education, mutual support, and advocacy, enabling an environmentally and socially responsible, healthy and prosperous environment that improves the quality of life.

Position Overview:

The U.S. Green Building Council's Massachusetts Chapter is seeking a communications intern to assist with a range of communications projects.

Candidates must:

  • work well independently
  • be able to work from home
  • have reliable transportation to attend events and Chapter meetings
  • have a passion for expanding the green building industry

The Chapter is seeking an Intern who is detail oriented, proactive, ideally has prior experience with the MA Chapter, is a member in good standing, is comfortable working with websites and databases.

Responsibilities:?

The Intern will report to the Chapter Operations Manager and Communications Committee Chair and will meet at least once a week with the Chapter Operations Manager for updates and planning. Interns are expected to work from the USGBC MA Chapter office at least once a week. The Intern will attend monthly Membership Committee meetings and will be required to attend a hands-on website and database training.

Students and recent graduates with a degree in communications, public relations, marketing, or related field are encouraged to apply. Advanced undergraduate students are also encouraged to apply. Depending on skills and interests, intern projects may include:

  • Maintaining and updating the Chapter distribution lists
  • Graphic design work on chapter materials
  • Assisting with website maintenance, monthly newsletters, and media outreach.
  • Helping to maintain partner relationships.
  • Writing and editing press releases and summaries on Chapter news
  • Monitoring local green building news and reporting relevant items to Chair
  • Supporting Communications Committee work, attending monthly meetings

Qualifications:?

General Job requirements:

  • Ideally studying marketing, communications, business, public affairs, government affairs or other related courses, whether as a major or as a minor in an architectural, engineering, environmental studies, or other associated discipline
  • Must be computer and internet savvy; website experience/knowledge a definite plus, with proficiency in word, excel, and photoshop. Experience with CiviCRM, Drupal, and/or javascript a definite advantage
  • Graphic Design experience a plus
  • Prepared to do both innovative and everyday work??
  • Good written and verbal skills
  • Highly organized and a good communicator
  • Willing to commit to working hard and, once committed, being reliable
  • Knowledge of construction, environmental issues or energy conservation a plus.

This is a?6 month commitment of 10 hours a week. (1 year is preferred)
