Samsung appeals Apple injunction against Galaxy Tab

IDG News Service - Lawyers for Samsung Electronics have petitioned a U.S. court to suspend a preliminary injunction that blocks its Galaxy Tab 10.1 tablet computer from sale in the country.

The South Korean electronics company filed papers on Wednesday at the U.S. District Court for the Northern District of California asking that the order be suspended pending an appeal.

The filing came a day after Judge Lucy Koh barred sales of the tablet and any "product that is no more than colorably different from this specified product and embodies any design contained in U.S. Design Patent No. D504,889."

Koh also ordered Apple to post a bond for $2.6 million toward any damages sustained by Samsung if the injunction is subsequently found to be erroneously enjoined.

Samsung argued the injunction on a number of points, including that Apple's evidence against the Galaxy Tab 10.1 is "seven months or older." Such injunctions are typically granted to prevent prospective harm from sales of the allegedly offending product, but that doesn't exist pending more current data from Apple, the company argued in the filing.

"Samsung not only has a strong likelihood of success on appeal given the Court's issuance of a preliminary injunction based on a stale record, but, absent a stay, the injunction will cause Samsung significant harm due to impaired relationships with customers and carriers, while causing no demonstrable injury to Apple," Samsung argued in its filing.

Samsung's appeal represents the latest round in a patent battle between the two companies that centers over a handful of patents covering product design.

Apple first asked for an injunction against the Galaxy Tab 10.1 in July last year. Koh denied the injunction in December, ruling that Apple was likely to suffer irreparable harm as a result of Samsung infringing the '889 design patent but that the patent itself was likely invalid.

The ruling ended up in the appeals court, which upheld Judge Koh's initial finding of infringement and irreparable harm with respect to the '889 Patent, but disagreed with her finding on the validity of the patent. That appeals court finding opened the door to this week's injunction.

JOHANNESBURG (AP) ? A South African woman and her Italian partner were handcuffed throughout the nearly two years they were held by Somali pirates, who fed them little but rice, pasta and bread, the now-freed couple said Wednesday after arriving in South Africa.

Deborah Calitz and Bruno Pelizzari, captured in late 2010 from a yacht off the coast of Tanzania, spoke to reporters at an emotional Johannesburg airport news conference. They were freed in Somalia last week and stopped in Italy to see Pelizzari's family before coming to South Africa, where friends and relatives draped in yellow ribbon printed with the word "believe" greeted them at the airport with tears, hugs and flowers.

"We were treated like untouchables" in Somalia, Calitz said. "We were treated worse than animals at times."

The two were held captive 20 months, among the longest periods hostages have been held by Somali pirates.

Relatives have said the two were sailing on a budget after buying a used yacht several years ago to pursue a dream of traveling the world's seas. At the time they were kidnapped, they were working for another South African yachtsman to earn money for a visit home.

The pirates originally demanded a ransom of $10 million, which relatives had said they could not pay. Their relatives in South Africa sought donations and organized concert fundraisers, and said the pirates kept changing their demand.

"Thank you for not giving up on us," a tearful Calitz told her friends and relatives Wednesday. She also thanked the governments of South Africa, Somalia and Italy.

"We're home! We're safe! And we're happy!" she said.

Calitz said Wednesday the couple did not know whether a ransom was paid. Last week, Somalia's defense minister said Somali security forces helped secure the release. He did not describe it as a rescue, but would not say if a ransom was paid. Most such cases end with payment of multi-million dollar ransoms, which security experts say only inspires more hostage-taking.

South Africa's foreign minister, Maite Nkoana-Mashabane, who met the couple at the airport Wednesday, told reporters the hostage-taking could only end once stability was brought to Somalia. Somalia has been beset by decades of civil war, and its last fully functioning government collapsed in 1991, allowing piracy and other crime to flourish. In more recent years, al-Qaida-linked militants have gained a foothold in the Horn of Africa nation.

Pelizzari echoed the South African foreign minister's calls for peace.

"We've created a rainbow nation in South Africa," he said, referring to the negotiated, peaceful end to white racist rule here. "We've got to do the same for the world."

LevelUp Studio introduces Peti, a free puzzle game for Android

Most folks will know the name of LevelUp Studio from their Plume and Beautiful Widgets apps but they've gone ahead and ventured into a new area with their latest release. Yup, gaming is now on the developers list and as such they've now unveiled a pretty fun and free puzzle game called Peti.

Peti (People for Ethical Treatment of Invaders) will place you in a new world wherein you must save aliens that fall to Earth and send them back to their mother, all in an effort to keep her happy so that she doesn't destroy all of humanity.

Overall, the game will feel familiar you to you as it takes on a retro style much like Tetris or Dr. Mario but given that it adds plenty of new twists, achievements and special powers to make it more than a "drop and place" puzzle game, it's certainly one to check out.

The graphics and characters are fun, the game itself is challenging plus, it's free. For a first run at gaming, I'd say LevelUp Studio did quite well. Grab the download, check out the game trailer below and let us know what you all think of Peti in the comments.
